In a surprising turn of events, New York City schools have been granted a temporary reprieve from enforcing a vaccine mandate for teachers and staff, just as it was set to be implemented. Approximately a month prior, Mayor Eric Johnson announced that all educators and school personnel in the nation’s largest school district needed to receive at least their first vaccine dose by September 27.
On Friday, September 24—just two days before the mandate was scheduled to take effect—a federal appeals judge intervened, placing a temporary hold on the enforcement of the vaccine requirement. The case was initiated by four city educators and has been expedited to a three-judge panel, which is slated to review it on Wednesday, September 29.
“We believe our vaccine mandate will ultimately stand, as it provides essential protection for our students and staff,” stated a spokesperson from the New York City Department of Education, Jamie Carter, in a report to NBC New York. While the mandate remains on hold, unvaccinated staff members are required to undergo weekly COVID testing and report their results back to the district.
Despite the potential for the mandate to be reinstated soon, the brief delay poses a risk, particularly with the more contagious Delta variant still circulating. Unlike other districts, New York City public schools are not offering remote learning options this academic year. According to Carter, about 82% of teachers and staff are vaccinated, although the United Teachers Association (UTA) estimates that around 6,000 of its members remain unvaccinated, with approximately half seeking medical exemptions.
Parents are expressing mixed emotions regarding the implications for their children’s safety, and many are left feeling confused about the situation. Frustration is prevalent over the perceived lack of planning and clarity surrounding the mandate. The recurring question on many minds is, why are some adults refusing the vaccine?
